General Terms and Conditions of Use and Agency Services

WUNDERORTE.life is a recommendation and agency service for personally selected locations, hotels, holidays, and leisure and experience packages.

Scope

These General Terms and Conditions govern the collaboration between WUNDERORTE.life and the hosts and partners featured on WUNDERORTE.life.

Selection and Inclusion

A WUNDERORT does not impress through its size or star rating, nor is ‘high-end’ the decisive factor.

Our selection is based on the W.U.N.D.E.R. criteria:

Our recommendations prioritise quality and authenticity over quantity.

We believe in fair collaboration, genuine encounters and sustainable tourism.

Getting to Know Each Other and Publication

A 15-minute introductory meeting is free of charge.

The inclusion of a selected WUNDERORT and its publication on WUNDERORTE.life are free of charge.

There are no costs for guests or interested parties arising from the use of agency services provided via WUNDERORTE.life.

Enquiries and Agency Services

Enquiries are forwarded by WUNDERORTE.life to the relevant host or partner.

The relevant host or provider has sole discretion over availability, prices and whether to accept an enquiry.

WUNDERORTE.life does not accept bookings or reservations on behalf of hosts and does not manage booking calendars.

Contract between Guest and Host

The contract for the relevant accommodation, trip, event, culinary experience, activity or other service is concluded exclusively between the guest and the relevant host or provider.

WUNDERORTE.life is not a party to this contract.

The contract is governed by the prices, payment terms, cancellation policies and other agreements of the respective host or provider.

Details regarding prices, availability and services on WUNDERORTE.life are based on the information provided by the respective host or provider. Only the terms and conditions confirmed by the respective host or provider are binding.

Performance-based Commission

For a booking that is verifiably arranged via WUNDERORTE.life and actually carried out, the performance-based commission individually agreed with the respective host or partner shall apply.

The amount and basis for calculating the commission shall be agreed individually prior to publication.

The commission shall be settled once the arranged booking has been completed.

Attribution of a Booking

A booking is deemed to have been arranged via WUNDERORTE.life if the enquiry was forwarded to the host or partner via WUNDERORTE.life.

Responsibilities of Hosts and Partners

Hosts and partners are responsible for the services they offer, as well as for the accuracy and up-to-date nature of their information.

In particular, they are responsible for availability, prices, booking and payment processing, cancellations and the proper fulfilment of their services.

WUNDERORTE.life must be notified promptly of any material changes to the information displayed on WUNDERORTE.life.

With regard to any texts, photographs, logos and other content provided, the host or partner must ensure that they hold the necessary rights for the agreed use.

The use of the content provided is also governed by the relevant participation or partnership agreement.

No Guarantee of Enquiries or Bookings

WUNDERORTE.life does not guarantee any specific number of enquiries, bookings or turnover.

Duration and Termination of the Collaboration

The collaboration does not constitute membership, exclusivity or a minimum term.

The collaboration may be terminated by either party at any time.

Termination of the collaboration does not affect the agreed commission for any bookings arranged via WUNDERORTE.life prior to termination.

If these bookings are actually carried out after the collaboration has ended, the agreed commission will be invoiced as normal.

Liability

WUNDERORTE.life shall be liable without limitation for damage caused intentionally or through gross negligence by WUNDERORTE.life, its legal representatives or vicarious agents, as well as for damage resulting from a culpable injury to life, limb or health.

In the event of a breach of essential contractual obligations due to slight negligence, liability is limited to the foreseeable damage typical for this type of contract.

Otherwise, liability for damage caused by slight negligence is excluded to the extent permitted by law.

WUNDERORTE.life shall not be liable for the services, bookings or the performance of contracts concluded directly between guests and hosts or providers, insofar as WUNDERORTE.life is not itself responsible for this.

Mandatory statutory liability provisions remain unaffected.

Data Protection
Personal data is processed in accordance with the applicable data protection regulations.

Insofar as this is necessary for establishing contact or arranging a booking, the data required for this purpose may be forwarded to the relevant host or partner.

Final Provisions

Individual agreements with a host or partner take precedence over these General Terms and Conditions.

Should any individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the relevant statutory provisions.

German law applies to the cooperation with hosts and partners.

If the host or partner is a trader, a legal person under public law or a special fund under public law, the place of jurisdiction shall be Mainz.
